Setting Fines for Cartels (2017)


The mandate of the Cartel Working Group is to address the challenges of anti-cartel enforcement, including the prevention, detection, investigation and punishment of cartel conduct. At the heart of antitrust enforcement is the battle against hard core cartels directed at price fixing, bid rigging, market allocation and output restriction.

The Cartel Working Group is co-chaired by Brazil's CADE, the South African Competition Commission, and the Directorate General for Competition, European Commission.

The Cartel Working Group consists of two subgroups:

Subgroup 1: Legal Framework addresses the legal and conceptual challenges of anti-cartel enforcement.  The focus of the subgroup is examining policy-level issues of the institutional and investigative framework for the detection and punishment of hard core cartels.


Subgroup 2: Enforcement Techniques aims to improve the effectiveness of anti-cartel enforcement by identifying and sharing specific investigative techniques and advancing the education and information sharing agenda of the Cartel Working Group.


Current Work

  • Organizing a webinar series on issues such as parental liability, international cooperation and ex officio investigations (webinars are replayed at different times to facilitate access for all members);
  • Organizing the 2017 ICN Cartel Workshop;
  • Compiling key elements for an efficient and effective leniency programme and its application;
  • Updating the content of the Anti-Cartel Enforcement Manual; and
  • Updating/Completing Anti-Cartel Enforcement Templates.

ICN Cartel Workshops

The 2016 ICN Cartel Workshop was held in Madrid, Spain in October 2016. The 2017 ICN Cartel Workshop will be held in Canada from 4 to 6 October 2017.
